Election Tool Box for 4099 Opposition Group Members - Ontario Election


Ontario politicians control the rails of re-development process

Provincial politicians seeking your vote, will have the following constitutional jurisdiction, i.e. the following tools, in their Ontario Legislature tool boxes, if they become or continue to be a Member of the Provincial Parliament in Toronto:


  1. The power to allow the City of Mississauga or the Region of Peel to exist or be replaced by some other govening entity,

  2. The power to enact any legislation of any kind dealing with Municipal Law,

  3. The power to establish and set the powers of a Super-Mayor, including overriding City Council,

  4. The power to enact any law related to "property and civil rights", including the law of commercial leases and commercial rent control, if any,

  5. The power to enact any law dealing with roads and highways,

  6. The power to control and fund, or not fund, public transit,

  7. The power to establish or amend any municipal process for Developers' applications respecting Official Plans by Cities, re-zoning of properties, and rights of appeal,

  8. The power to establish the Ontario Land Tribunal, appointment of its Tribunal Judges, and the rights and processes for entities appearing before it,

  9. The power to establish Provincial Housing Standards,

  10. The power to pass Provincial Environmental legislation and Carbon-emission controls.


Some provincial candidates will say that once elected, they will have NO jurisdiction over the 4099 Erin Mills Parkway re-development issue. You need to be ready to challenge them on such statements. You need to be ready to fact-check what any candidate or politician says. The first item we need to put in our own tool boxes is basic knowledge of provincial jurisdiction and the provincial power to control City of Mississauga and Ontario Land Tribunal jurisdiction.


We need to meet with each other and talk about that jurisdiction.


Members of the 4099 Opposition Group need their own tool boxes ready at their doors, ready at the nomination meeting for the party(s) of their choice, and at all-candidates meetings. Our tool boxes should include basic knowledge of Canadian constitutional law, i.e. what provincial politicians can do and what provincial politicians cannot do in Parliament. Our tool boxes should include subtle questions for each candidate at our doors and blunt questions for each candidate at the doors:


  1. Will you meet with constituents or their representatives when they have questions about major issues in the community?

  2. Will you answer my letters?

  3. Will you respond to questions by the media about 4099 Erin Mills Parkway?

  4. Will your political party force the City of Mississauga, to build condo towers at 4099 Erin Mills parkway?

  5. Will your political party interfere with the municipal jurisdiction of Mississauga City Council to decide whether or not the application by Queenscorp to re-develop 4099 Erin Mills Parkway should be approved?

  6. Are land Developers or their Associations significant donors to your election campaign or your party's election campaign?

  7. Should the small business tenants at 4099 Erin Mills Parkway be protected?

  8. Should the historical commercial nature of 4099 Erin Mills Parkway be protected?


What items, ideas, and questions should 4099 Opposition Group members put into boxes, folders, clipboards that they keep by their front doors, in preparation for visits by political candidates coming to ask for their votes in the forthcoming Ontario provincial election?


Are you prepared to work with other members of the 4099 Opposition Group to build such tool boxes, folders, and clipboards for residents? Will you talk to your neighbours about preparation of their own tool boxes?


We all need help in using civil and accurate language.


We also need tools that help us to fact-check what friends, neighbours, and social media tell us.



Exclusive Powers of Provincial Legislatures

92 In each Province the Legislature may exclusively make Laws in relation to Matters coming within the Classes of Subjects next hereinafter enumerated; that is to say,

  • 1. 

    Repealed.End note (48)

  • 2. 

    Direct Taxation within the Province in order to the raising of a Revenue for Provincial Purposes.

  • 3. 

    The borrowing of Money on the sole Credit of the Province.

  • 4. 

    The Establishment and Tenure of Provincial Offices and the Appointment and Payment of Provincial Officers.

  • 5. 

    The Management and Sale of the Public Lands belonging to the Province and of the Timber and Wood thereon.

  • 6. 

    The Establishment, Maintenance, and Management of Public and Reformatory Prisons in and for the Province.

  • 7. 

    The Establishment, Maintenance, and Management of Hospitals, Asylums, Charities, and Eleemosynary Institutions in and for the Province, other than Marine Hospitals.

  • 8. 

    Municipal Institutions in the Province.

  • 9. 

    Shop, Saloon, Tavern, Auctioneer, and other Licences in order to the raising of a Revenue for Provincial, Local, or Municipal Purposes.

  • 10. 

    Local Works and Undertakings other than such as are of the following Classes:

    • (a) 

      Lines of Steam or other Ships, Railways, Canals, Telegraphs, and other Works and Undertakings connecting the Province with any other or others of the Provinces, or extending beyond the Limits of the Province:

    • (b) 

      Lines of Steam Ships between the Province and any British or Foreign Country:

    • (c) 

      Such Works as, although wholly situate within the Province, are before or after their Execution declared by the Parliament of Canada to be for the general Advantage of Canada or for the Advantage of Two or more of the Provinces.

  • 11. 

    The Incorporation of Companies with Provincial Objects.

  • 12. 

    The Solemnization of Marriage in the Province.

  • 13. 

    Property and Civil Rights in the Province.

  • 14. 

    The Administration of Justice in the Province, including the Constitution, Maintenance, and Organization of Provincial Courts, both of Civil and of Criminal Jurisdiction, and including Procedure in Civil Matters in those Courts.

  • 15. 

    The Imposition of Punishment by Fine, Penalty, or Imprisonment for enforcing any Law of the Province made in relation to any Matter coming within any of the Classes of Subjects enumerated in this Section.

  • 16. 

    Generally all Matters of a merely local or private Nature in the Province.
