Accused was driving when he got a flat tire, fell into a ditch and trapped in snow. The vehicle could not be driven. He cleared the snow from his exhaust pipe and asked a passing motorist to call a tow truck. The first tow truck was not adequate. While he waited for the second tow truck to arrive he drank vodka. The second tow truck arrived with police.
