Accused had drank much earlier and was neither impaired or over 80 when he was driving. He dropped a cigarette in his car, lost control hit a curb and had a flat tire on the driver's side an no tire on the passenger side. He couldn't call anyone at the time so he sat in the driver's side, threw his keys in the back and drank fruit juice and vodka. He then fell asleep with no intention of driving.
