-on January 14, 1983 accused charged with refusing to comply with a demand by police officer to provide a breath sample for analysis is a roadside screening device. -stopped by police officer who was on "spot check duty" -purpose of "spot check duty" is to check licences, insurence, mechanical fitness of cars and sobriety of the driver. -no guidelines, no criteria, standards or procedure on which vehicles should be stopped.
