The date set for trial was some eight months after the respondent was charged with assault causing bodily harm. However, on the date set for trial, as was his right, the accused elected, through counsel, to be tried by a higher court. A preliminary inquiry was commenced on that date instead. Following committal for trial, a trial date was set for some five months hence.
